Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Omnifling Ltd and its licensors.

 

Copyright

By placing an order, customers certify that they hold all rights to use, publish, and transmit the data (including text and image material) they provide to us. The customer is responsible for ensuring that the content of the product does not infringe on anyone else’s intellectual property rights or violate applicable legislation.
The customer agrees not to hold TCG Bling responsible for any claims made by third parties, especially regarding copyright infringement, arising from the use of data provided by the customer. The customer agrees to indemnify and hold TCG Bling, its directors, officers, employees, agents, affiliates, and subsidiaries harmless from any claims, damages, costs, and expenses, including attorney fees, related to third-party rights infringement.

The content on the site, including software, source code, text, images, and other materials (collectively referred to as “Content”), is owned, controlled, or licensed by TCG Bling and is protected by copyrights, trademarks, or other intellectual property rights. The Content is intended for personal and non-commercial use only. Customers are prohibited from reproducing, publishing, transmitting, distributing, displaying, modifying, creating derivative works, selling, or exploiting the Content or the Site in any way, except as permitted or noted. This rule apply to all content with the exception of the artworks, illustrations and/or paintings that are the creation of the artist Vanette Kosman (artistic name “Clayscence”) who is the sole owner of said content.

We reserve the right to terminate customer accounts and remove any contributed content without prior notice, at its sole discretion.
We reserve the right to access and disclose information, including usernames and other account details, to comply with applicable laws and government requests.

 

 

Inappropriate Content

TCG Bling reserves the right to remove illegal, offensive, racist, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive or inflammatory, pornographic images or texts. We may also refuse to print designs deemed offensive.
The uploaded content to TCG Bling must not contain any material that defames individuals, groups of people, races or religions.
The content must be free from any form of harmful or malicious code, including viruses, trojan horses, worms, time bombs, cancelbots, or any other computer programming routines that have the potential to cause damage, disruption, unauthorized interception, or misappropriation of systems, programs, data, or personal information.
The content must not employ deceitful or misleading tactics. It does not endorse or circulate deceitful merchandise, services, plans, or promotions that are intended to defraud. If you have questions regarding the accepted material please don’t hesitate to contact us.

 

Property Release

By approving and granting TCG Bling a non-exclusive, royalty-free worldwide license to use and publish your design, you agree to the following terms:
We have the right to use and publish your design for marketing purposes in any paid and unpaid media and marketing channel, including social media, newsletters, advertisements, and the TCG Bling website.
We do not claim ownership of your design, and this license does not grant us the right to sell products or similar items featuring the design. Any agreements related to the sale of products with the design will be handled separately.

 

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Omnifling Ltd.

Omnifling Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Omnifling Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

 

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
